DMCA Copyright Policy

1. Introduction

Chaos Theory Studios LLC ("Hue42," "we," "us," or "our") respects the intellectual property rights of others and expects users of our Service to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable laws.

This policy explains:

  • How to report copyright infringement on Hue42
  • What happens after we receive a DMCA notice
  • How to submit a counter-notification
  • Consequences for repeat infringers

2. What Content is Protected?

Copyright law protects original works of authorship, including:

  • Images, graphics, and artwork
  • Design elements and compositions
  • Text, articles, and written content
  • Photography
  • Software and code

What is NOT Protected

Copyright does not protect:

  • Individual colors: You cannot copyright a single color hex code (e.g., #8B5CF6)
  • Color palettes (generally): Collections of colors arranged together typically lack sufficient originality for copyright protection, though specific creative arrangements may qualify
  • Ideas or concepts: Only specific expressions of ideas
  • Facts: Color names, RGB values, etc.
  • Public domain works: Content with expired copyrights or dedicated to the public

Important Note About Color Palettes

While individual color combinations are generally not copyrightable, associated creative content (like palette names, descriptions, images, or artistic presentations) may be protected. When in doubt, respect others' creative work and seek permission before using it.

3. How to File a DMCA Takedown Notice

If you believe your copyrighted work has been copied and is accessible on Hue42 in a way that constitutes copyright infringement, you may submit a DMCA takedown notice.

3.1 Required Information

Your notice must include the following information (17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work:

    Describe the work you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.

  2. Identification of the infringing material:

    Provide the specific URL(s) or location(s) on Hue42 where the infringing material appears. Be as specific as possible (e.g., "https://hue42.com/username/palette-name").

  3. Your contact information:

    Include your full name, mailing address, telephone number, and email address.

  4. A statement of good faith belief:

    "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

  5. A statement of accuracy:

    "The information in this notice is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the copyright owner."

  6. Your physical or electronic signature:

    A physical signature or typed full name.

4. What Happens After We Receive Your Notice

4.1 Review Process

When we receive a valid DMCA notice:

  1. We will review the notice for completeness and validity
  2. If the notice is complete, we will remove or disable access to the allegedly infringing content
  3. We will notify the user who posted the content that it has been removed
  4. We will provide the user with your DMCA notice (minus your contact details if you request)
  5. The user may submit a counter-notification (see below)

4.2 Timing

We aim to process valid DMCA notices within 48-72 hours of receipt.

4.3 Incomplete Notices

If your notice is incomplete or doesn't meet DMCA requirements, we will notify you and request additional information. We are not obligated to process incomplete notices.

5. Counter-Notification (Restoring Removed Content)

If you believe your content was removed in error or misidentification, you may submit a DMCA counter-notification.

5.1 Required Information

Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement consenting to jurisdiction in your district (or where Hue42 is located if you're outside the US)
  6. A statement that you will accept service of process from the person who filed the original DMCA notice

5.2 Where to Send Your Counter-Notification

5.3 What Happens Next

If we receive a valid counter-notification:

  1. We will forward it to the party who filed the original DMCA notice
  2. If the original filer does not notify us within 10-14 business days that they have filed a lawsuit, we may restore the removed content
  3. If we receive notice of a lawsuit, the content will remain removed pending the court's decision

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

We may also, in our sole discretion, limit access to the Service and/or terminate accounts of users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.

7. Misuse of DMCA Process

Under the DMCA, anyone who knowingly materially misrepresents that content is infringing may be subject to liability. This includes:

  • Filing false DMCA notices
  • Filing false counter-notifications
  • Abusing the DMCA process to harass users

Warning

Filing a false DMCA notice or counter-notification may result in legal liability for damages, including costs and attorney's fees. Please ensure you have a valid legal claim before submitting a notice.

8. Fair Use and Other Exceptions

Before filing a DMCA notice, please consider whether the use of your work may be protected by fair use or other exceptions to copyright law. Fair use allows limited use of copyrighted material without permission for purposes such as:

  • Criticism, commentary, or parody
  • News reporting
  • Teaching or education
  • Research

Courts consider several factors in determining fair use, including the purpose of the use, the nature of the copyrighted work, the amount used, and the effect on the market value.
